HOLMDEL ENTITLED TO MILLIONS IN BACK TAXES ON ART CENTER

The Appellate Division of the Superior Court of New Jersey has confirmed that the Township of Holmdel is entitled to recover back property taxes, estimated to be in excess of $30 million, as the PNC Bank Arts Center and the Robert B. Meyner Reception Center are no longer exempt from taxation. The case was argued for 9 years by Lindabury attorney Bud Rose. (December 2006)

David G. Hardin gave a presentation on November 20, at Our House, a non-profit group providing assistance to individuals with developmental disabilities, including the provision of group homes. David spoke about estate planning and wills, including charitable bequests and special needs trusts. BIG WIN FOR THE MECHANICAL CONTRACTORS ASSOCIATION OF NJ

The Mechanical Contractors Association of New Jersey, represented by Lindabury attorneys Ed Frisch and Bruce Ogden, have successfully appealed their case involving subcontractor substitution on jobs for the New Jersey School Construction Corporation. On October 19, the Appellate Division overturned the lower court ruling that allowed the NJSCC to substitute subcontractors after bids had been awarded. (October 2006)

The International Association of Defense Counsel, in its May 2006 Newsletter, published an article by surety attorneys Roger Sauer and Paul Mazer on the interrelationship between adherence to the bonding company's own billing guidelines in paying its counsel and the claim of 'bad faith' by an indemnitor. Roger and Paul consider this a maverick opinion, but one nonetheless worthy of concern, particularly given its provenance out of a prominent District Court in Pennsylvania.
