Bruce Ogden concentrates his practice on healthcare law, public bidding controversies and construction claims.
In his healthcare practice, Bruce has considerable experience with medical staff peer review and privileging issues, patient consent, treatment, and discharge matters, and medical records compliance. He also is experienced in healthcare litigation, including emergent patient and other court proceedings, and Certificate of Need and other types of regulatory and licensing matters. He assists healthcare providers in their business, professional, personnel and charitable transactions, such as with bylaws and contract review and preparation, fraud and abuse and non-profit tax compliance, labor relations, and property and estate matters.
Bruce also has extensive experience in construction and surety law, including presenting and defending emergent bidding disputes, as well as compliance counseling with respect to public construction procurement. On public and private jobs, he represents clients with contract review and preparation, securing payment, claims counseling, and when necessary, presenting or defending construction claims in litigation or arbitration.
Bruce has authored several articles, including "Avoiding the Nasty Surprise: Gaps in Health Care Providers' Liability Insurance Coverage," New Jersey Lawyer, No. 173 (12/95) and "Peer Review and the HCQIA's Civil Damages Immunity," published in the NJSBA Health Law Section Newsletter. In 1997, he secured a significant decision on an issue of first impression, in Kuehne Chemical Co., Inc. v. North Jersey District Water Supply Comm., Superior Court of New Jersey, Appellate Division, app. for pub. 5/9/97 (bids for public contract are public records, including pre-award).
