LINDABURY ATTORNEY APPEARS BEFORE THE APPELLATE DIVISION OF THE NEW JERSEY SUPERIOR COURT
October 29, 2009
On Wednesday, October 21, 2009, Edward J. Frisch, partner in the construction law group, appeared and presented oral argument in the appellate division of the NJ Superior Court in Alan O’Shea and The Mechanical Contractors Association of New Jersey, Inc., vs. New Jersey Schools Development Authority, and the State of New Jersey.

Mr. Frisch delivered the position of the Mechanical Contractors Association, challenging the ability of the New Jersey Schools Development Authority to implement a pilot program of up to six "design-build" school projects, having a value in excess of $225,000,000. Mr. Frisch stated that the proposed design-build program would undermine the competitive bidding policies of the State of New Jersey, and thus would be contrary to the taxpayers' interests. Furthermore, it would threaten to reduce the opportunities for the MCANJ's members and other tradesmen to successfully compete for plumbing, HVAC and other subcontracts. It would incentivize the three or four general contractors chosen to repeatedly use subs who maximize the GC's personal advantage, rather than give a broad based opportunity to all qualified trades, who like the MCANJ members, offer the best competitive prices.
