General Description: Our real estate attorneys possess extensive experience in handling all aspects of land ownership and use, whether it be a routine title closing for a residential property owner or a complex transaction involving commercial or industrial property.

We routinely represent individuals and business entities in connection with the sale, lease, and use of all types of real property. Such representation includes the negotiation and drafting of purchase contracts, leases, easements, options, and other instruments; completing title examinations and closing titles; negotiating and structuring the financing of projects; providing assistance with tax and environmental issues; advising clients with respect to landlord-tenant matters; and representing clients in condemnation proceedings. We also have significant experience in representing the developers of projects for residential, commercial, and industrial use including both residential and office condominiums. Additionally, we have represented several homeowner associations of residential condominium developments.

The firm’s land use attorneys routinely counsel clients who appear before municipal planning boards, boards of adjustment and governing bodies in municipalities throughout New Jersey, in connection with zoning and land use matters. Group members are skilled in all types of zoning and planning matters including project facilitation, re-development, environmental permitting, site plan and subdivision, and other approvals for commercial, residential and mixed-use projects. The Group represents contractors and developers in the procurement of permits at all governmental levels pertaining to wetlands, brownfield, and other environmentally sensitive sites, often in conjunction with the firm’s environmental lawyers. The firm has handled appeals of zoning variances and permits to municipal governing bodies, counseled clients in disputes with municipalities concerning water and sewer connection fees, and appeared in municipal courts to defend zoning and other code violations. In addition, we also counsel clients who oppose municipal efforts to rezone their property or nearby property which will affect them, along with clients who seek a zone change to permit a proposed development. LMEC land use attorneys also frequently appear before environmental agencies, county planning boards, and municipal construction departments in connection with permitting issues involving environmental regulations, the BOCA Code, and New Jersey’s Uniform Construction Code. While we seek to resolve issues at the initial level, our representation includes appeals before County Construction Boards of Appeals as well the Superior Court.
