{"id":1106,"date":"2015-12-24T10:52:56","date_gmt":"2015-12-24T15:52:56","guid":{"rendered":"http:\/\/events.lindabury.com\/?p=1106"},"modified":"2019-12-24T13:15:27","modified_gmt":"2019-12-24T18:15:27","slug":"osha-provides-employers-guidelines-restroom-access-transgender-employees","status":"publish","type":"post","link":"https:\/\/www.lindabury.com\/firm\/insights\/osha-provides-employers-guidelines-restroom-access-transgender-employees.html","title":{"rendered":"OSHA Provides Employers with Guidelines on Restroom Access for Transgender Employees"},"content":{"rendered":"<p>Throughout the years OSHA has promulgated a substantial set of regulations to improve overall health and safety in the workplace, including the requirement that employers provide employees with sexually-segregated sanitary toilet facilities. On June 1, 2015, the Occupational Safety and Health Administration (\u201cOSHA\u201d) issued a best practices guide for employers titled <em><a href=\"https:\/\/www.osha.gov\/newsrelease\/trade-20150601.html\" target=\"_blank\" rel=\"noopener noreferrer\">\u201cA Guide to Restroom Access for Transgender Workers.\u201d<\/a><\/em> The publication\u2019s core principle is that all employees, including transgender employees, should have access to restrooms that correspond to their gender identity.<\/p>\n<p>In its publication OSHA acknowledged the potential questions employers will face regarding which facilities a transgender employee should use. According to OSHA, \u201ca person who identifies as a man should be permitted to use the men&#8217;s restroom and a person who identifies as a woman should be permitted to use the women&#8217;s restroom.\u201d OSHA\u2019s policy is based on the reasoning \u201cthat restricting employees to using only restrooms that are not consistent with their gender identify, or requiring them to use gender-neutral or other specific restrooms, singles those employees out and may make them fear for their physical safety.&#8221;\u00a0 Additionally, OSHA believes these restrictions can result in employees avoiding the use of restrooms while at work, which can lead to potentially serious physical injury or illness.<\/p>\n<p>OSHA observed that the best employer policies provide various\u00a0 restroom options that the employee may choose, such as single-occupancy gender-neutral facilities and use of multiple-occupant, gender-neutral restroom facilities with lockable single occupant stalls. Moreover, employees cannot be required to use a segregated facility apart from other employees because of their gender identity or transgender status.
