{"id":1118,"date":"2015-12-24T11:44:00","date_gmt":"2015-12-24T16:44:00","guid":{"rendered":"http:\/\/events.lindabury.com\/?p=1118"},"modified":"2025-02-05T11:21:38","modified_gmt":"2025-02-05T16:21:38","slug":"narrower-darden-test-joint-employer-status-title-vii","status":"publish","type":"post","link":"https:\/\/www.lindabury.com\/firm\/insights\/narrower-darden-test-joint-employer-status-title-vii.html","title":{"rendered":"Third Circuit Adopts Narrower Darden Test to Determine Joint Employer Status for Purposes of Title VII"},"content":{"rendered":"<p>In a prior post we discussed the new test adopted by the National Labor Relations Board for determining when <a href=\"https:\/\/www.lindabury.com\/firm\/2015\/10\/nlrb-announces-new-joint-employer-standard-significantly-extends-liability-to-employers-for-workplace-labor-violations-by-contractors.html\" target=\"_blank\" rel=\"noopener\">two entities can be deemed \u201cjoint employers\u201d equally liable for unfair employment practices<\/a> in violation of the National Labor Relations Act.\u00a0 Now, the Third Circuit Court of Appeals (with jurisdiction over federal courts in NJ, DE and Eastern PA), has announced the test for determining when two entities can be deemed \u201cjoint employers\u201d equally liable for violations of federal anti-discrimination laws.<\/p>\n<p>The bad news is that the Third Circuit\u2019s decision in <em>Faush v. Tuesday Morning, Inc.<\/em>, D.C. Civ. No. 2-12-cv-07137 (Nov. 18, 2015) may significantly impact companies who secure workers through staffing agencies or other third party providers. The good news is that the <em>Tuesday Morning<\/em> court rejected a broad test that would have made it easier for employees to establish \u201cjoint employer\u201d status in favor of a narrower test that may make it easier for an employer to resist \u201cjoint employer\u201d status.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>The Facts:<\/strong><\/span> Matthew Faush, African American, was employed by Labor Ready, a staffing agency providing temporary workers to retailer Tuesday Morning, Inc.\u00a0 Following his termination, Rauch filed suit against Tuesday Morning claiming race discrimination in violation of Title VII and the Pennsylvania Human Relations Act (PHRA).
