{"id":4789,"date":"2021-07-19T09:28:39","date_gmt":"2021-07-19T13:28:39","guid":{"rendered":"https:\/\/www.lindabury.com\/firm\/?p=4789"},"modified":"2025-02-24T13:14:49","modified_gmt":"2025-02-24T18:14:49","slug":"new-jersey-cracks-down-further-on-employee-misclassification","status":"publish","type":"post","link":"https:\/\/www.lindabury.com\/firm\/insights\/new-jersey-cracks-down-further-on-employee-misclassification.html","title":{"rendered":"New Jersey Cracks Down Further on Employee Misclassification"},"content":{"rendered":"<p>In early 2020, Governor Murphy signed a series of bills aimed at identifying and penalizing businesses for misclassification of employees as independent contractors.\u00a0 On July 8, 2021, New Jersey enacted four additional laws to further its previous efforts to combat misclassification of workers.<\/p>\n<p><strong>A5890: Injunctions and Stop-Work Orders \u00a0<\/strong><\/p>\n<p>This law, effective immediately, allows the Commissioner of the Department of Labor and Workforce Development (\u201cDOL\u201d) to seek a superior court injunction to prevent ongoing violations of State wage, benefit, and tax laws stemming from employee misclassification.\u00a0 Previously alleged violations were handled administratively before the Office of Administrative Law (\u201cOAL\u201d).\u00a0 Under this new law, the Commissioner can bypass the OAL and go straight to court.\u00a0 If the Commissioner prevails, all remedies are available to the victims of misclassification. \u00a0\u00a0Additionally, the Court shall award reasonable attorney\u2019s fees and litigation and investigation costs.\u00a0 Determining whether to pursue an enforcement action is left to the \u201csole discretion\u201d of the Commissioner.<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.lindabury.com\/firm\/insights\/new-jersey-cracks-down-further-on-employee-misclassification.html\"  title=\"Continue Reading New Jersey Cracks Down Further on Employee Misclassification\" class=\"more-link\">Continue Reading \u203a<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>In early 2020, Governor Murphy signed a series of bills aimed at identifying and penalizing businesses for misclassification of employees as independent contractors.\u00a0 On July 8, 2021, New Jersey enacted four additional laws to further its previous efforts to combat misclassification of workers.
