{"id":538,"date":"2014-10-23T00:00:00","date_gmt":"2014-10-23T04:00:00","guid":{"rendered":"http:\/\/events-lindabury.blawgcloud.com\/2014\/10\/appellate-division-extends-new-jersey-law-against-discrimination-to-divorcing-employees.html"},"modified":"2019-12-23T17:37:34","modified_gmt":"2019-12-23T22:37:34","slug":"appellate-division-extends-new-jersey-law-against-discrimination-to-divorcing-employees","status":"publish","type":"post","link":"https:\/\/www.lindabury.com\/firm\/insights\/appellate-division-extends-new-jersey-law-against-discrimination-to-divorcing-employees.html","title":{"rendered":"Appellate Division Extends New Jersey Law Against Discrimination to Divorcing Employees"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.lindabury.com\/resources\/The_Supreme_Court_Eases_Burden_for_Retaliation_Claims_Under_the_LAD\/\">New Jersey Law Against Discrimination<\/a> (\u201cLAD\u201d) has long prohibited discrimination against individuals on the basis of their \u201cmarital status,\u201d barring employers from considering an individual\u2019s status as married or unmarried in making any employment decisions.\u00a0\u00a0 In the recent case of a New Jersey appeals court recently examined the scope of the marital status protections of LAD and determined that they also extend to engaged, separated and divorced individuals.<\/p>\n<p><strong>The Facts: <\/strong>Robert Smith, Director of Operations for the Millville Rescue Squad (\u201cMillville\u201d), supervised over one hundred employees, including his wife. In February 2005, Smith had an affair with a subordinate who later resigned, and shortly thereafter, Smith and his wife separated. \u00a0Mr. Smith\u2019s supervisor became aware of Smith\u2019s affair and subsequent separation and told him he could not promise these developments would not affect Smith\u2019s job, that it \u201call depends on how it shakes down.\u201d \u00a0Several months later, Smith\u2019s employment was terminated for poor work performance. Smith\u2019s supervisor purportedly told Smith that he had to present the situation to Millville\u2019s board of directors because he believed there was no chance of reconciliation between Smith and his wife and \u201cit\u2019s going to be an ugly divorce.\u201d \u00a0Smith filed suit alleging marital status discrimination in violation of the LAD.<\/p>\n<p><strong>The Ruling: <\/strong>In the proceedings below, the trial court dismissed Smith\u2019s marital discrimination claim because Smith failed to present evidence that Millville fired him because he was either married or unmarried. The Court reasoned that Millville had the right to terminate Smith because it was concerned about the potential impact his divorce proceedings might have on his work.
