{"id":548,"date":"2015-02-02T00:00:00","date_gmt":"2015-02-02T05:00:00","guid":{"rendered":"http:\/\/events-lindabury.blawgcloud.com\/2015\/02\/retroactive-fmla-for-employers-its-all-about-the-timing.html"},"modified":"2025-02-05T11:27:21","modified_gmt":"2025-02-05T16:27:21","slug":"retroactive-fmla-for-employers-its-all-about-the-timing","status":"publish","type":"post","link":"https:\/\/www.lindabury.com\/firm\/insights\/retroactive-fmla-for-employers-its-all-about-the-timing.html","title":{"rendered":"Retroactive FMLA: For Employers It\u2019s All About The Timing"},"content":{"rendered":"<p><strong>By: <a href=\"https:\/\/www.lindabury.com\/attorneys\/Kathleen_Connelly\/\">Kathleen Connelly, Esq.<\/a><\/strong><\/p>\n<p>A recent holding by a New Jersey federal court in serves to remind employers that when employees fail to give timely notice of the need for medical leave they may be forfeiting the protections of the <a href=\"https:\/\/www.lindabury.com\/resources\/DOL_Clarifies_Leave_Rights_Under_the_FMLA\/\">Family and Medical Leave Act (FMLA)<\/a>.<\/p>\n<p><strong>The Facts: <\/strong>On May 24, 2011 Camden County Corrections Officer Walter Radlinger had fully exhausted his intermittent family leave under the FMLA, and his subsequent absences were thus deemed absences without leave (AWOL) by the County, which triggered disciplinary action.\u00a0 In lieu of termination, the parties entered into a settlement agreement whereby Radlinger agreed to a 90 day staggered suspension, one year of probation and an acknowledgement that future abuse of the County\u2019s FMLA, sick leave or absenteeism policies would result in termination proceedings.<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.lindabury.com\/firm\/insights\/retroactive-fmla-for-employers-its-all-about-the-timing.html\"  title=\"Continue Reading Retroactive FMLA: For Employers It\u2019s All About The Timing\" class=\"more-link\">Continue Reading \u203a<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>By: Kathleen Connelly, Esq.
