{"id":549,"date":"2015-02-02T00:00:00","date_gmt":"2015-02-02T05:00:00","guid":{"rendered":"http:\/\/events-lindabury.blawgcloud.com\/2015\/02\/the-supreme-court-speaks-time-spent-by-workers-at-employer-security-checkpoints-is-not-compensable-under-the-fmla.html"},"modified":"2025-02-05T11:28:03","modified_gmt":"2025-02-05T16:28:03","slug":"the-supreme-court-speaks-time-spent-by-workers-at-employer-security-checkpoints-is-not-compensable-under-the-fmla","status":"publish","type":"post","link":"https:\/\/www.lindabury.com\/firm\/insights\/the-supreme-court-speaks-time-spent-by-workers-at-employer-security-checkpoints-is-not-compensable-under-the-fmla.html","title":{"rendered":"THE SUPREME COURT SPEAKS:  Time Spent by Workers at Employer Security Checkpoints is Not Compensable Under the FMLA"},"content":{"rendered":"<p><strong>By: Kathleen Connelly, Esq.<\/strong><\/p>\n<p>In its rare unanimous, pro-employer ruling in \u00a0the United States Supreme Court held that under the Fair Labor Standards Act (FLSA), employers are not obligated to compensate employees for time spent undergoing employer-mandated security checkpoints after normal working hours. \u00a0\u00a0The ruling resolved a split between rulings from the Ninth Circuit Court of Appeals, and all other federal appeals courts considering the issue &#8211; The Ninth Circuit Court ruled employers were obligated to compensate employees for this time, while other federal courts concluded the time was not compensable time worked within the meaning of the FMLA.<\/p>\n<p><strong>The Facts: <\/strong>\u00a0Integrity Staffing Solutions, Inc. (\u201cIntegrity), a storage and order-filling facility for Amazon.com, implemented security procedures requiring workers to pass through security checkpoints for up to 25 minutes before leaving the facility.
