{"id":667,"date":"2015-03-11T10:13:46","date_gmt":"2015-03-11T14:13:46","guid":{"rendered":"http:\/\/events-lindabury.blawgcloud.com\/?p=667"},"modified":"2019-12-23T18:31:51","modified_gmt":"2019-12-23T23:31:51","slug":"shift-from-coah-to-state-courts-could-be-a-boon-to-developers","status":"publish","type":"post","link":"https:\/\/www.lindabury.com\/firm\/insights\/shift-from-coah-to-state-courts-could-be-a-boon-to-developers.html","title":{"rendered":"Shift from COAH to State Courts Could be a Boon to Developers"},"content":{"rendered":"<p>On March 10, 2015 the New Jersey State Supreme Court issued a unanimous ruling allowing trial courts in the state, rather than the state Council on Affordable Housing (\u201cCOAH\u201d), to decide if towns are providing enough low- and moderate-income housing.\u00a0 The Court issued its decision after finding that COAH has repeatedly failed to establish new affordable housing guidelines.<\/p>\n<p>The Court has delayed the implementation of its ruling for 120 days in order to allow parties to prepare \u201cfair share\u201d or \u201chigher density\u201d arguments.\u00a0 Ninety days after the Court\u2019s March 10th ruling, municipalities will have 30 days to file declaratory judgment actions seeking immunity from litigation.\u00a0 Municipalities will need to show the court they have either (1) achieved substantive certification from COAH under prior iterations of the Third Round Rules before they were invalidated, or (2) had achieved \u201cparticipating\u201d status before COAH.\u00a0 If at the conclusion of the 120 day period municipalities have not either filed for a declaratory judgment, or have not been granted immunity, \u201cbuilder\u2019s remedy\u201d actions may be brought against the municipality.<\/p>\n<p>Currently 314 of 565 municipalities in New Jersey have plans pending before COAH.\u00a0 Developers and their counsel should remain vigilant as to how trial courts rule on declaratory judgment motions filed by these municipalities.\u00a0 For developers seeking to begin real estate development projects in any of the 251 New Jersey municipalities that do not have plans pending before COAH, developers may seek the assistance of the courts after 90 days from March 10, 2015.<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.lindabury.com\/firm\/insights\/shift-from-coah-to-state-courts-could-be-a-boon-to-developers.html\"  title=\"Continue Reading Shift from COAH to State Courts Could be a Boon to Developers\" class=\"more-link\">Continue Reading \u203a<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court Shifts Affordable Housing Responsibility to Trial Courts in New Jersey<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[399,99,65,249],"tags":[],"coauthors":[173],"class_list":["post-667","post","type-post","status-publish","format-standard","hentry","category-banking-financial-services-insights","category-pierce","category-insights","category-real-estate-land-use-zoning-insights"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.7 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Shift from COAH to State Courts Could be a Boon to Developers &#8212; March 11, 2015 &#8212; Lindabury, McCormick, Estabrook &amp; Cooper, P.C.
