James K. Estabrook has devoted most of his career to attending to the legal requirements of the closely held business owner. He has developed several areas of emphasis including Federal and state income, estate and gift taxation, ERISA and employee benefit law.
Jim serves as general counsel to the Mechanical Contractors Association of New Jersey, Inc. and the Mechanical Contracting Industry Council of New Jersey. Through that role, he has served, since 1982, as co-counsel to the Boards of Trustees of twenty-eight related employee benefit funds, including the Pipefitters Local Union No. 274 Funds and IBEW Local Union No. 456 Funds.
Jim acts as legal counsel to the trustees for collectively bargained multiemployer ("Taft-Hartley") benefit funds; primarily in the construction trades. In this capacity, Jim has advised on matters involving ERISA compliance, fiduciary responsibility, legal standards for plan design, participation, benefit accrual, vesting, and funding as well as other implementation and administration issues impacting the tax qualified status of such plans. Jim also serves by appointment from a national trade association as independent professional trustee, on the side of management, on several large multiemployer trust funds. Jim has experience in both the single and multiemployer plan arena, with U.S. Department of Labor and Internal Revenue Service investigation and compliance issues, 401(K) plan mergers, prohibited transactions, and reporting and disclosure requirements.
Jim regularly lectures before clients and civic organizations on estate planning and employee benefits. In estate planning, he has appeared before such organizations as the National Council on Aging and the New Jersey Geriatric Care Managers. On employee benefits, he has spoken before the Annual Conference of International Foundation of Employee Benefits Plans, the Annual Conference of the Union Affiliated Contractors of the National Association of Plumbing-Heating-Cooling Contractors and the Taft-Hartley Trustee seminar sponsored by the United Association and the Mechanical Contractors Association of New Jersey, Inc.
Jim also serves as a member of the Board of Trustees of several of the firm's clients including the Gateway Regional Chamber of Commerce, Union County Alliance (Chairman, Long Range Planning Committee), Henry H. Kessler Foundation (Chairman, Board of Trustees), and the Linden Industrial Association (Secretary).
