On January 20, 2026, Governor Phil Murphy signed legislation expanding the New Jersey Prevailing Wage Act to require payment of prevailing wages on the construction of data centers designed for electrical capacity of 5 megawatts or greater annually after construction, regardless of whether the project receives public funding. Effective April 1, 2026, covered projects must comply with all prevailing wage requirements administered by the NJ Department of Labor and Workforce Development, including contractor registration and certified payroll reporting. This marks a significant shift from a public-funding-based trigger to an industry-specific capacity threshold, bringing large-scale private data center construction within New Jersey’s prevailing wage framework.
