Mark Scancarella is a Partner who concentrates his practice in estate planning, trusts, probate and estate administration. He helps individuals and families protect their assets, prepare for incapacity and establish clear plans for transferring property to the people and organizations that matter to them.
Mark works with clients at many stages of life. Some are creating their first estate plan after getting married, having a child or purchasing a home. Others need to update an existing plan as their families, assets and responsibilities change. He also advises clients who are approaching retirement or caring for aging parents.
Mark prepares wills, revocable and irrevocable trusts, powers of attorney and advance health care directives. He helps clients determine who should manage their financial affairs or make medical decisions if they become unable to act for themselves. He also counsels parents on selecting guardians for minor children and establishing trusts through which an inheritance can be managed responsibly. Where appropriate, he advises on strategies intended to simplify the transfer of assets, provide for beneficiaries and address potential New Jersey and federal tax considerations.
Mark assists with reviewing and updating documents following significant life events, including marriage, divorce, the birth or adoption of a child, the purchase or sale of a business, the acquisition of substantial assets or changes in the health or death of a family member. Mark also provides more specialized planning including the establishment of trusts for young beneficiaries or protecting assets for persons with special needs.
In addition to planning, Mark represents executors, administrators, trustees and beneficiaries in probate and estate administration matters. He guides fiduciaries through the process of admitting a will to probate, identifying and valuing estate assets, satisfying tax and reporting obligations, maintaining appropriate records and distributing property to beneficiaries. He also advises beneficiaries who have questions about the administration of an estate or trust and want to better understand their rights.
Before joining Lindabury, Mark was a Partner at Dempsey, Dempsey & Sheehan. He brings to each engagement a strong understanding of New Jersey estate law and a commitment to making the legal process understandable.
